On 12-Oct-2026, India's Enforcement Directorate (ED) confirmed that 1.68 billion rupees (₹168 crore) in suspected criminal proceeds are involved in an alleged money laundering scheme linked to insolvency process manipulation. The case serves as a powerful reminder of how corporate insolvency mechanisms, related parties, and off-book cash can be weaponized to conceal the movement of illicit value.

"India's Enforcement Directorate (ED) has arrested the chairman of the Sadhna Group, a Delhi-based media and broadcasting company, under the Prevention of Money Laundering Act (PMLA) following allegations of engineered insolvency proceedings."

Rakesh Kumar Gupta, 63, was arrested late on Friday 9 October 2026 under the PMLA. The ED puts the alleged proceeds of crime at approximately 168 crore rupees (1.68 billion rupees). Mr. Gupta has not been convicted; the allegations remain untested and the judicial investigation is continuing.

What Is Alleged: The Mechanics of the Scheme

The case originated from a First Information Report (FIR) registered by the Delhi Police Economic Offences Wing in September, prompting the ED to initiate an inquiry under the money laundering law. At the centre of the probe is the insolvency of Sadhna Media Pvt Ltd.

  • Engineered Creditor Control: Related creditors allegedly controlled 99.41% of the Committee of Creditors (CoC), the decision-making body determining how the insolvent company's liabilities are handled.
  • Tax Obligation Evaporation: Income tax dues of ₹110.10 crore were allegedly settled for just ₹20 lakh (2 million rupees).
  • Diversion to Connected Entities: The company was directed to pay ₹4.48 crore to creditors connected to the promoter, including ₹2.99 crore to a linked entity, Sharpline Broadcast.
  • Cash, Crypto & Hawala Channels: Over ₹2 crore in cash was allegedly routed through cryptocurrency and hawala networks following the resale of Sadhna Media and the Aryan TV channel.

The Court's Decision

Produced before Additional Sessions Judge Saurabh Pratap Singh Laler, defence counsel argued that neither the securities regulator (SEBI) nor the income tax department had filed formal complaints, that a tax no-dues certificate was held, and that a prior SEBI penalty had been paid. The court rejected these arguments, affirming that the ED's mandate is independent and noting that the money trail extended outside the banking system with seized digital evidence pending forensic analysis.

Why It Matters for Compliance Teams

• Related-Party Networks: When counterparties on both sides of a transaction are covertly connected, standard onboarding CDD checks will not flag the risk. Uncovering ultimate beneficial controllers is non-negotiable. • Value Moving Outside Banking Rails: Cash, crypto off-ramps, and informal hawala networks leave data blind spots. Subtle irregularities—such as sudden debt haircuts or unverified creditor assignments—are often the primary early warning indicators. • Inter-Agency Regulatory Blind Spots: Disconnected oversight between tax authorities, securities regulators, and banking supervisors creates systemic gaps where money laundering thrives.
